7. Delivery Terms

We aim to deliver all orders within the estimated delivery time provided at checkout. However, delivery times are estimates only and are not guaranteed. Factors outside our control, including adverse weather conditions, traffic, or high order volumes, may cause delays. Apache Pizza accepts no liability for losses arising from late delivery.

Delivery is available only within designated delivery zones associated with each Apache Pizza outlet. It is your responsibility to ensure that the delivery address provided is accurate and accessible. We reserve the right to charge additional fees or cancel the order if the delivery address is incorrect or falls outside the designated delivery zone.

Risk in the goods passes to you upon delivery to the address specified in your order. If no one is available to receive the delivery, our driver may leave the order in a safe location at the delivery address, or may return the order and you may be charged for the failed delivery.

8. Allergen Information

Apache Pizza takes allergen awareness seriously. Allergen information for all menu items is available on our Website and in-store. However, please be advised that our food products are prepared in kitchens where allergens including gluten, nuts, dairy, eggs, and other common allergens are present. Nothing in this clause shall prevent either party from seeking urgent injunctive or other equitable relief from the Irish courts where necessary to prevent irreparable harm.

Apache Pizza shall not be held liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from causes beyond our reasonable control, including but not limited to acts of God, fire, flood, storm, earthquake, pandemic, epidemic, civil unrest, war, terrorism, strikes, industrial action, governmental restrictions, or failure of third-party service providers, including telecommunications or internet infrastructure providers.

In the event of a force majeure event, we will endeavour to notify you as soon as reasonably practicable and to resume normal service as quickly as possible. If the force majeure event continues for a period exceeding 30 consecutive days, either party may terminate any affected order or agreement without liability, subject to a refund of any amounts paid for services not yet rendered.

If any provision of these Terms is found by a court of competent jurisdiction or other authoritative body to be invalid, illegal, or unenforceable under applicable Irish law, that provision shall be deemed severed from the remainder of these Terms to the minimum extent necessary. Such severance shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue in full force and effect.

Where any invalid, unenforceable, or illegal provision would be valid, enforceable, and legal if some part of it were deleted or modified, the provision shall apply with the minimum modification necessary to make it legal, valid, and enforceable.
